A BILL TO BE ENTITLED
AN ACT
relating to license application procedures for pharmacy
applicants.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 554.003, Occupations Code, is amended to
read as follows:
Sec. 554.003. PROCEDURES. (a) The board by rule shall
specify in accordance with this section:
(1) the licensing procedures to be followed, including
specification of forms to be used, in applying for a pharmacy
license; and
(2) fees for filing an application for a pharmacy
license.
(b) Not later than the 20th day after the date a license
application is submitted to the board under this chapter, the board
shall provide written notice to the applicant of any deficiency in
the applicant's qualifications or credentials related to obtaining
a pharmacy license under this subtitle or with regard to a facility
regulated under this subtitle.
(c) The board shall place in the file of each applicant
applying for a pharmacy license written documentation of:
(1) the investigation process conducted by the board
on the application;
(2) all information regarding the applicant or related
to the applicant's application that is shared by the board with any
other state or federal agency; and
(3) any assistance with respect to the application
provided by a state or federal agency to the board as part of the
application process.
(d) On request by the applicant, the board shall provide to
the applicant, in a timely manner, a copy of the information placed
in the applicant's file under Subsection (c) or as required by board
rule.
SECTION 2. The Texas State Board of Pharmacy shall adopt the
rules and procedures required by Section 554.003, Occupations Code,
as amended by this Act, not later than January 1, 2006.
SECTION 3. This Act takes effect September 1, 2005.
