A BILL TO BE ENTITLED

AN ACT

relating to requiring a permit for the processing of grease trap 
waste or grit trap waste or a combination of the two at a treatment 
facility permitted under Texas Water Code Chapter 26.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 26, Water Code, is amended by adding 
Section 26.0287 to read as follows:
	Sec. 26.0287.  PERMIT REQUIRED FOR PROCESSING OF GREASE TRAP 
AND GRIT TRAP WASTE
	The commission shall require that persons who process grease 
trap waste or grit trap waste or a combination of such liquid wastes 
at a treatment facility permitted under this Chapter obtain a 
permit or permit amendment to authorize such processing.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each House, as 
provided in Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
