A BILL TO BE ENTITLED

AN ACT

relating to the use of individuals' driving records in writing 
automobile insurance.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Article 5.01-1, Insurance Code, is repealed.                       
	SECTION 2.  The repeal of Article 5.01-1, Insurance Code, 
applies only to the use of a rating plan with reference to an 
automobile insurance policy that is delivered, issued for delivery, 
or renewed on or after the effective date of this Act.  The use of a 
rating plan with reference to an automobile insurance policy that 
is delivered, issued for delivery, or renewed before the effective 
date of this Act is governed by the law in effect immediately before 
the effective date of this Act, and that former law is continued in 
effect for that purpose.
	SECTION 3.  This Act takes effect September 1, 2005.
