A BILL TO BE ENTITLED

AN ACT

relating to proportional representation of the public entities 
participating in certain municipal power agencies on the boards of 
directors of those municipal power agencies.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter D, Chapter 163, Utilities Code, is 
amended by adding Section 163.103 to read as follows:
	Sec. 163.103.  PROPORTIONAL REPRESENTATION IN VOTING BY 
BOARD.  The board of directors of a municipal power agency created 
under this subchapter shall assign a number of votes to each 
director equal to the number of kilowatt hours of energy the agency 
sold to the public entity that director represents in the calendar 
year 2004 so that each director's voting power in proportion to the 
total voting power of the board of directors is equal to the energy 
consumption of the public entity that director represents in 
proportion to the total energy consumption of all public entities 
having representation on the board of directors.
	SECTION 2.  This Act takes effect September 1, 2005.
