A BILL TO BE ENTITLED
AN ACT
relating to the residence of a voter who resides on property located
in more than one territory.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 11.001, Election Code, is amended to
read as follows:
Sec. 11.001. ELIGIBILITY TO VOTE. (a) Except as otherwise
provided by law, to be eligible to vote in an election in this
state, a person must:
(1) be a qualified voter as defined by Section 11.002
on the day the person offers to vote;
(2) be a resident of the territory covered by the
election for the office or measure on which the person desires to
vote; and
(3) satisfy all other requirements for voting
prescribed by law for the particular election.
(b) For a person who resides on property located in more
than one territory described by Subsection (a)(2), the residence of
the person is in the territory in which the person's dwelling
structure is located.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
