A BILL TO BE ENTITLED

AN ACT

relating to the use of a fixed rate of return in county jail 
commissary contracts.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 351.0415, Local Government Code, is 
amended by amending Subsection (b) and adding Subsection (e) to 
read as follows:
	(b)  The sheriff:                                                              
		(1)  has exclusive control of the commissary funds;                           
		(2)  shall maintain commissary accounts showing the 
amount of proceeds from the commissary operation and the amount and 
purpose of disbursements made from the proceeds; [and]
		(3)  shall accept new bids to renew contracts of 
commissary suppliers every five years; and
		(4)  shall consider entering into a contract under this 
section that offers the county a fixed rate of return, through per 
diem, monthly, or annual lump-sum payments.
	(e)  The sheriff may not enter into a contract under this 
section that would result in the displacement of county employees.
	SECTION 2.  This Act takes effect September 1, 2005.
