A BILL TO BE ENTITLED
AN ACT
relating to the creation of the position of county elections administrator. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 31.031, Election Code, is amended by amending Subsection (a) and adding Subsection (e) to read as follows: (a) Except as provided by Subsection (e), the [The] commissioners court by written order may create the position of county elections administrator for the county. (e) The commissioners court of a county with a population of 250,000 or more by written order shall create the position of county elections administrator for the county. SECTION 2. Section 31.048(a), Election Code, is amended to read as follows: (a) The commissioners court of a county with a population of less than 250,000 by written order may abolish the position of county elections administrator at any time. SECTION 3. Section 31.071(a), Election Code, is amended to read as follows: (a) The commissioners court of a county with a population of less than 250,000 by written order may transfer to the county tax assessor-collector the duties and functions of the county clerk in connection with the conduct of elections if the county tax assessor-collector and county clerk agree to the transfer. SECTION 4. This Act takes effect September 1, 2005.
