A BILL TO BE ENTITLED
AN ACT
relating to requiring public schools to establish a drug awareness
program.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 38, Education Code, is
amended by adding Section 38.019 to read as follows:
Sec. 38.019. DRUG AWARENESS PROGRAM. (a) A school district
shall establish a campus drug awareness program.
(b) A campus drug awareness program under this section must:
(1) monitor drug use on campus;
(2) provide a process for tracking reported drug use;
(3) provide education services relating to drug use;
and
(4) establish group drug counseling for middle school,
junior high school, and high school students.
(c) The agency by rule shall develop a drug awareness
program that complies with this section. A school district may:
(1) adopt the program developed by the agency; or
(2) subject to approval by the commissioner, adopt a
program developed by the district.
(d) In developing a drug awareness program under Subsection
(c)(2), a school district may consult with:
(1) parents of district students;
(2) educators;
(3) state agencies, local governments, and private
entities that provide education services and drug prevention and
treatment services in the district; and
(4) other groups the district determines appropriate.
SECTION 2. This Act applies beginning with the 2006-2007
school year.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
