A BILL TO BE ENTITLED

AN ACT

relating to the regulation of mobile food units and roadside food 
venders in certain populous areas.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 437, Health and Safety Code, is amended 
by adding Section 437.0021 to read as follows:
	Sec. 437.0021.  REGULATION OF MOBILE FOOD UNITS AND ROADSIDE 
FOOD VENDORS IN CERTAIN POPULOUS AREAS.  A municipality with a 
population of 1.5 million or more and a county with a population of 
3.4 million or more shall enforce state law and rules adopted under 
state law concerning mobile food units and roadside food vendors in 
the same manner it enforces other health and safety regulations 
relating to food service.
	SECTION 2.  This Act takes effect September 1, 2005.
