A BILL TO BE ENTITLED

AN ACT

relating to the weighing of a loaded vehicle.                                 
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 621.402(b), Transportation Code, is 
amended to read as follows:
	(b)  The officer may require that the vehicle be driven to 
the nearest available scales, except that the officer may not 
require that the vehicle be driven to scales that are more than five 
miles from the location at which the officer stops the vehicle 
unless the scales are in the same direction the vehicle was 
traveling.
	SECTION 2.  This Act takes effect September 1, 2005.
