A BILL TO BE ENTITLED
AN ACT
relating to the development and availability of a curriculum
regarding acquired immune deficiency syndrome and human
immunodeficiency virus infection.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 81, Health and Safety
Code, is amended by adding Section 81.0221 to read as follows:
Sec. 81.0221. CURRICULUM REGARDING AIDS AND HIV INFECTION.
(a) The department, in consultation with the Texas Education
Agency, shall develop a fact-based, age-appropriate curriculum and
related materials for public school students regarding acquired
immune deficiency syndrome and the prevention of human
immunodeficiency virus infection.
(b) On request of the Texas Education Agency or a school
district, the department shall provide the curriculum and related
materials to a school district and, if possible, assist the
district in implementing the curriculum.
(c) The department shall develop the curriculum and related
materials required by this section not later than August 1, 2006.
This subsection expires September 1, 2006.
SECTION 2. Section 28.004, Education Code, is amended by
adding Subsection (l) to read as follows:
(l) Subsection (e) does not apply to course materials
obtained by a school district under Section 81.0221, Health and
Safety Code, or instruction based on those materials.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
