A BILL TO BE ENTITLED
AN ACT
relating to repealing the authority of certain nonprofit
corporations to exercise the power of eminent domain.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 178, Acts of the 56th Legislature,
Regular Session, 1959 (Article 3183b-1, Vernon's Texas Civil
Statutes), is repealed.
SECTION 2. The repeal of Chapter 178, Acts of the 56th
Legislature, Regular Session, 1959 (Article 3183b-1, Vernon's
Texas Civil Statutes), by this Act, applies only to the acquisition
of real property by eminent domain on or after the effective date of
this Act. Proceedings to acquire property by eminent domain under
that chapter that are pending on the effective date of this Act
pursuant to a petition to initiate condemnation proceedings against
the property filed before the effective date of this Act are void
and shall be terminated on the effective date of this Act.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
