A BILL TO BE ENTITLED
AN ACT
relating to the required public notice of the name of each finalist
for the position of chief executive officer of an institution of
higher education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 552.123, Government Code, is amended to
read as follows:
Sec. 552.123. EXCEPTION: NAME OF APPLICANT FOR CHIEF
EXECUTIVE OFFICER OF INSTITUTION OF HIGHER EDUCATION. (a) The name
of an applicant for the position of chief executive officer of an
institution of higher education is excepted from the requirements
of Section 552.021, except that the governing body of the
institution must give public notice of the name or names of the
finalists being considered for the position at least 21 days before
the date of the meeting at which final action or vote is to be taken
on the employment of the person.
(b) In addition to the names of persons described by
Subsection (a), the public notice required by Subsection (a) must
include the name of each applicant the governing body interviewed
two or more times.
SECTION 2. This Act takes effect September 1, 2005.
