A BILL TO BE ENTITLED
AN ACT
relating to the exclusion of certain materials from a reservation 
of minerals to the state.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter A, Chapter 53, Natural Resources 
Code, is amended by adding Section 53.002 to read as follows:
	Sec. 53.002.  EXCLUSION OF CERTAIN MATERIALS FROM 
RESERVATION OF MINERALS TO STATE.  Unless otherwise expressly 
provided by statute or by a deed, patent, or other grant from the 
state, a reservation of minerals to the state does not include sand, 
gravel, caliche, rock, or other similar materials.
	SECTION 2.  This Act applies to a reservation of minerals to 
the state under a conveyance that is made before, on, or after the 
effective date of this Act.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
