A BILL TO BE ENTITLED
AN ACT
relating to the privacy of public employees under the Public Information Act. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 552, Texas Government Code, is amended by adding Subsection 552.102(c) to read as follows: (c) Information is excepted from the requirements of Section 552.021 if it is information in a personnel file relating to the evaluation or assessment of an employee of a governmental body, except that such evaluation or assessment of an employee is to be made available to that employee or the employee's designated representative as public information is made available under this chapter. The exception to public disclosure created by this subsection is in addition to any other exception covered by this section. This subsection shall not apply to evaluations or assessments of the administrative head of a governmental body or any department or division head reporting to such individual. SECTION 2. EFFECTIVE DATE. This Act takes effect September 1, 2005.
