A BILL TO BE ENTITLED
AN ACT
relating to operation of a motor vehicle by a person younger than 18 years of age. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter O, Chapter 521, Transportation Code, is amended by adding Section 521.3467 to read as follows: Sec. 521.3467. AUTOMATIC REVOCATION FOR FAILURE TO MAINTAIN EDUCATIONAL REQUIREMENTS. (a) A license of a person younger than 18 years of age who has not obtained a high school diploma or its equivalent is automatically revoked if the person: (1) ceases to be enrolled in a public school, home school, or private school or does not attend school for at least 80 days during each fall or spring semester; or (2) ceases to be enrolled in a program to prepare persons to pass the high school equivalency exam. (b) A person whose license is revoked under Subsection (a) shall promptly surrender the license to the department. SECTION 2. Section 545.424, Transportation Code, is amended by amending Subsection (a) and adding Subsection (a-1) to read as follows: (a) A person under 18 years of age, during the six-month period following issuance of an original Class A, B, or C driver's license to the person, may not operate a motor vehicle[: [(1)] after midnight and before 5 a.m. unless the operation of the vehicle is necessary for the operator to attend or participate in employment or a school-related activity or because of a medical emergency. (a-1) A person under 18 years of age may not operate a motor vehicle[; or (2)] with more than one passenger in the vehicle under 21 years of age who is not a family member. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
