A BILL TO BE ENTITLED
AN ACT
relating to service retirement benefits for certain peace officers. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 814.107, Government Code, is amended by adding Subsection (h) to read as follows: (h) A member who has at least 25 years of service credit as a law enforcement or custodial officer is eligible to retire regardless of age and receive a full service retirement annuity equal to the amount available to a member who retires under this section at the earlier of the age of 50 with at least 20 years of service credit or the age at which the sum of the member's age and amount of service credit in the employee class equals the number 80. Benefits for service described by this subsection are payable from the trust fund established by Section 815.310. SECTION 2. This Act applies only to a law enforcement or custodial officer who retires on or after the effective date of this Act. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
