A BILL TO BE ENTITLED

AN ACT

relating to the eligibility to vote in special utility district 
elections.  
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter C, Chapter 65, Water Code, is amended 
by adding Section 65.104 to read as follows:
	Sec. 65.104.  ELIGIBILITY TO VOTE IN DISTRICT ELECTIONS.  A 
person is eligible to vote in a district election if the person is a 
qualified voter as defined by Section 11.002, Election Code, and 
the person is:
		(1)  a district resident; or                                           
		(2)  a user of district facilities.                                    
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
