A BILL TO BE ENTITLED
AN ACT
relating to the maintenance of a registry of certain voluntarily
provided information by the Texas Infrastructure Protection
Communications Center.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 421, Government Code, is
amended by adding Section 421.083 to read as follows:
Sec. 421.083. REGISTRY OF VOLUNTARILY PROVIDED PRIVATE
SECURITY DEPARTMENT INFORMATION. (a) In this section, "security
department of a private business" means a security department that
acts as the security department of a private business in accordance
with Section 1702.182, Occupations Code.
(b) The center shall receive information about a private
business that is voluntarily provided to the center by the head of
the security department of the private business.
(c) The center shall develop and maintain a registry of
information about private businesses received under Subsection (b)
that may assist the center with its functions under this
subchapter, including:
(1) the name of a private business;
(2) the address of a private business;
(3) the name of the head of the security department of
a private business; and
(4) any telephone, fax, and pager numbers voluntarily
provided as contact information for the head of a security
department.
(d) Information received and maintained by the center under
this section is excepted from required disclosure under the public
information law, Chapter 552.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
