A BILL TO BE ENTITLED

AN ACT

relating to the model subdivision rules adopted by the Texas Water 
Development Board to assure that minimum standards for safe and 
sanitary water supply and sewer services in residential areas of 
certain political subdivisions are met.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 16.343, Water Code, is amended by adding 
Subsection (h) to read as follows:
	(h)  The model rules may not require an owner of a subdivided 
tract to provide a financial guarantee for a period of more than 
three years to ensure that any water supply or sewer facilities 
constructed or installed to service the tract meet the criteria 
specified by the model rules if the construction of a dwelling or 
other structure on the tract has not begun.
	SECTION 2.  This Act takes effect September 1, 2005.
