A BILL TO BE ENTITLED
AN ACT
relating to certain appointments made by the governor and the chief
justice of the supreme court.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 74.005, Government Code, is amended to
read as follows:
Sec. 74.005. APPOINTMENT OF REGIONAL PRESIDING JUDGES. (a)
The chief justice of the supreme court [governor, with the advice
and consent of the senate,] shall appoint one judge in each
administrative region as presiding judge of the region.
(b) On the death, resignation, or expiration of the term of
office of a presiding judge, the chief justice of the supreme court
[governor] immediately shall appoint or reappoint a presiding
judge.
SECTION 2. Section 815.002(a), Government Code, is amended
to read as follows:
(a) Three members of the board of trustees are appointed
with the advice and consent of the senate as follows [, one each
by]:
(1) two members appointed by the governor; and
(2) [the chief justice of the Supreme Court of Texas;
and
[(3)] one member appointed by the speaker of the house
of representatives.
SECTION 3. The amendment by this Act of Sections 74.005 and
815.002, Government Code, does not affect the term of a person
appointed under those sections before the effective date of this
Act.
SECTION 4. This Act takes effect September 1, 2005.
