A BILL TO BE ENTITLED
AN ACT
relating to the usage of plumbing controls in correctional
facilities in the Texas Department of Criminal Justice.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 493, government Code is amended by
adding Section 493.0101. to read as follows:
Sec. 493.0101. PLUMBING CONTROLS FOR CORRECTIONAL
FACILITIES.
(a) The department shall contract with a private provider to
install electronic water conservation devices for toilets, sinks
and showers in all correctional facilities under the purview of the
Texas Department of Criminal Justice. The terms of the contract
with the private provider contract will be for not less than 5
years.
(b) The electronic water conservation devices must yield an
annual savings of at least 50 percent.
(c) The private provider may not receive any remuneration
from the state until verified savings are achieved.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
