A BILL TO BE ENTITLED

AN ACT

relating to providing the Commissioner of Insurance the authority 
to establish a voluntary joint underwriting association when a bond 
or insurance is not reasonably available.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Article 21.49–3b, Insurance Code, is amended by 
adding subsection 19 to read as follows:
	(19)  The Commissioner may create a joint underwriting 
association and appoint its officers and directors who shall act 
pursuant to the provisions of this article for the purposes of 
issuing bonds.  The Commissioner shall adopt a plan of operation for 
such association which shall provide for the operation of the 
association on a self-supporting basis and shall include provisions 
for assessment of members of the association.
	SECTION 2.  This Act takes effect September 1, 2005.
