A BILL TO BE ENTITLED
AN ACT
relating to the regulatory authority of groundwater conservation
districts, underground water conservation districts, and other
districts and authorities authorized to regulate the spacing of
water wells, the production from water wells, or both.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 36.116, Water Code, is amended by adding
subsection (f) to read as follows:
(f) If a district adopts rules regulating the production of
groundwater under Subsections (a) through (e), the district may
only adopt rules reducing the amount of groundwater that may be
produced on a showing of sound hydrogeologic science that the
conditions of the aquifer or aquifers in the district do not support
the existing production limits or regulations.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
