A BILL TO BE ENTITLED

AN ACT

relating to the purchases and use of cross-platform software by 
state agencies.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter F, Chapter 2054, Government Code, is 
amended by adding Section 2054.129 to read as follows:
	Sec. 2054.129.  USE OF CROSS-PLATFORM SOFTWARE.  A state 
agency shall use cross-platform software.
	SECTION 2.  Subchapter B, Chapter 2157, Government Code, is 
amended by adding Section 2157.069 to read as follows:
	Sec. 2157.069.  PURCHASE OF CROSS-PLATFORM SOFTWARE.  For 
all software purchases, a state agency shall purchase 
cross-platform software products.
	SECTION 3.  (a)  Section 2054.129, Government Code, as added 
by this Act, applies only to the use of software acquired by a state 
agency on or after the effective date of this Act.  The use of 
software acquired before the effective date of this Act is governed 
by the law as it existed immediately before the effective date of 
this Act, and the former law is continued in effect for that 
purpose.
	(b)  Section 2157.069, Government Code, as added by this Act, 
applies only to a contract for the purchase of software by a state 
agency that is entered into on or after the effective date of this 
Act.  A contract for the purchase of software that is entered into 
by a state agency before the effective date of this Act is governed 
by the law in effect on the date the contract was entered into, and 
the former law is continued in effect for that purpose.
	SECTION 4.  This Act takes effect September 1, 2005.
