A BILL TO BE ENTITLED
AN ACT
relating to the operation of a motor vehicle. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 284.209, Transportation Code, is amended to read as follows: Sec. 284.209. ENFORCEMENT OF DECISION. A decision issued under Section 284.208(a) may be enforced by: (1) placing a device that prohibits movement of a motor vehicle on the vehicle that is the subject of the decision; (2) imposing an additional fine if the fine for the offense is not paid within a specified time; and [or] (3) refusing to allow the registration of the vehicle. SECTION 2. The heading of Section 502.185, Transportation Code, is amended to read as follows: Sec. 502.185. REFUSAL TO REGISTER VEHICLE BY [IN CERTAIN] COUNTIES OR DEPARTMENT. SECTION 3. Section 502.185(a), Transportation Code, is amended to read as follows: (a) A county assessor-collector or the department may refuse to register a motor vehicle if the assessor-collector or the department receives information that the owner of the vehicle owes a [the] county in this state money for a fine, fee, or tax that is past due. SECTION 4. (a) The changes in law made by this Act to Section 284.209, Transportation Code, apply only to a violation of an order that occurs on or after the effective date of this Act. A violation of an order that occurs before the effective date of this Act is governed by the law as it existed immediately before the effective date of this Act, and that law is continued in effect for this purpose. (b) The changes in law made by this Act to Section 502.185, Transportation Code, apply only to the registration of a motor vehicle that is applied for on or after the effective date of this Act. SECTION 5. This Act takes effect September 1, 2005.
