A BILL TO BE ENTITLED
AN ACT
relating to authority to conduct a closed meeting to discuss certain personnel matters involving a municipal advisory body. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 551.0745, Government Code, is amended to read as follows: Sec. 551.0745. PERSONNEL MATTERS AFFECTING COUNTY OR MUNICIPAL ADVISORY BODY; CLOSED MEETING. (a) This chapter does not require the commissioners court of a county or the governing body of a municipality to conduct an open meeting: (1) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a member of an advisory body; or (2) to hear a complaint or charge against a member of an advisory body. (b) Subsection (a) does not apply if the individual who is the subject of the deliberation or hearing requests a public hearing. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
