A BILL TO BE ENTITLED
AN ACT
relating to managing and maximizing federal money for certain state programs. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 39.074(a), Education Code, is amended to read as follows: (a) The commissioner may: (1) to ensure compliance with federal law or regulations, direct the agency to conduct on-site investigations at any time with regard to [answer any questions concerning] a program, including a special education program, required by federal law or for which the district receives federal funds; and (2) raise or lower the performance rating as a result of the investigation. SECTION 2. Section 382.011, Health and Safety Code, is amended by adding Subsection (d) to read as follows: (d) The commission shall coordinate with the Texas Department of Transportation to direct available funding resources of each agency to projects and categories of projects to achieve, at the lowest possible cost, the greatest benefits to air quality and to progress toward attainment of national ambient air quality standards in nonattainment areas. SECTION 3. Section 411.0098(b), Government Code, is amended to read as follows: (b) Procedures established under this section shall: (1) allow each agency to provide comments and advice to the other agency on an ongoing basis regarding statewide transportation planning efforts that affect traffic law enforcement; (2) define the role of each agency in transportation infrastructure efforts; and (3) require the department and the Texas Department of Transportation to develop a plan for applying for, maximizing, and using federal money [funds] to address infrastructure needs that affect enforcement efforts. SECTION 4. Section 421.002, Government Code, is amended by adding Subsection (d) to read as follows: (d) The governor's homeland security strategy must advise local governments of any changes in strategy for grants of federal money for homeland security. The governor may assist a local government in maximizing acquisition or efficient use of federal money. SECTION 5. Section 751.022, Government Code, is amended by adding Subsection (d) to read as follows: (d) The office shall undertake efforts to increase the state's share of federal money available for homeland security purposes to more fairly reflect the population of this state. SECTION 6. This Act takes effect September 1, 2005.
