A BILL TO BE ENTITLED

AN ACT

relating to the creation of a driver safety program for holders of 
provisional driver's licenses.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 521, Transportation Code, 
is amended by adding Section 521.032 to read as follows:
	Sec. 521.032.  PROVISIONAL LICENSE HOLDER DRIVER SAFETY 
PROGRAM.  (a)  The department shall create a driver safety program 
for provisional license holders.  The program shall:
		(1)  provide for voluntary participation and 
enrollment in the program by a provisional license holder; and
		(2)  establish a system for an operator of a vehicle on 
the highway to report irresponsible operation of a vehicle by a 
person who is participating or enrolled in the program.
	(b)  The department may solicit, accept, and administer 
gifts and grants from any public or private source for the use and 
benefit of the program.
	(c)  The department shall adopt rules for the administration 
of this section.
	(d)  The legislature may appropriate money to the department 
for support of the program.
	(e)  This section expires September 1, 2007.                            
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
