A BILL TO BE ENTITLED
AN ACT
relating to the enrollment of certain first-generation higher education students in the prepaid higher education tuition program. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 54.619, Education Code, is amended by adding Subsection (k) to read as follows: (k) Regardless of whether the board temporarily suspends other new enrollment under Subsection (j), with the authorization of the comptroller, the board may enter into a prepaid tuition contract with a purchaser to enroll in the program a beneficiary who does not have a biological or adoptive parent or grandparent who has attended a public or private institution of higher education in or outside of this state. The board shall adopt rules to administer this section, including rules prescribing the information that a prospective purchaser must submit to the board to demonstrate that a prospective beneficiary is eligible to be enrolled in the program under this subsection. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
