A BILL TO BE ENTITLED
AN ACT
relating to permitting a member of the Teacher Retirement System of
Texas to establish equivalent membership service for time spent
serving in the Peace Corps.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 823.401, Government Code, is amended by
amending Subsections (a) and (f) and adding Subsections (a-1) and
(f-1) to read as follows:
(a) Except as provided by Subsection (b), an eligible member
may establish equivalent membership service credit for:
(1) employment with a public school system maintained
wholly or partly by another state or territory of the United States
or by the United States for children of its citizens; or
(2) service in the Peace Corps.
(a-1) A school receiving funds under 22 U.S.C. Section 2701
is considered a public school for the purposes of this section.
(f) The amount of service credit a member may establish for
employment with a public school system described by Subsection
(a)(1) [under this section] may not exceed the lesser of the number
of years of membership service credit the member has in the
retirement system for actual service in public schools or 15 years.
(f-1) The amount of service credit a member may establish
for service in the Peace Corps as described by Subsection (a)(2) may
not exceed two years.
SECTION 2. This Act takes effect September 1, 2005.
