A BILL TO BE ENTITLED

AN ACT

relating to the minimum height required for guardrails on bridges 
or overpasses.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 472, Transportation Code, is amended by 
adding Subchapter E to read as follows:

SUBCHAPTER E.  CONSTRUCTION AND MAINTENANCE SPECIFICATIONS
	Sec. 472.041.  GUARDRAILS.  A guardrail constructed on a 
bridge or overpass located on a public road or highway in this state 
must be at least 36 inches in height.
	SECTION 2.  The change in law made by this Act applies to a 
guardrail that is constructed or replaced on or after the effective 
date of this Act.
	SECTION 3.  This Act takes effect September 1, 2005.
