A BILL TO BE ENTITLED
AN ACT
relating to protection of animal shelters from fireworks. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 823.008, Health and Safety Code, is added to read as follows: Sec. 823.008. OFFENSE. (a) A person may not explode or ignite fireworks, as defined by Section 2154.001, Occupations Code, within 600 feet of an animal shelter. (b) A violation of this section is a Class C misdemeanor. SECTION 2. (a) The changes in law made by this Act apply only to an offense committed on or after the effective date of this Act. For purposes of this section, an offense is committed before the effective date of this Act if any element of the offense ocurrs before that date. (b) An offense committed before the effective date of this Act is covered by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
