A BILL TO BE ENTITLED
AN ACT
relating to discovery of certain communications with a witness in a criminal case. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 38, Code of Criminal Procedure, is amended by adding Article 38.43 to read as follows: Art. 38.43. DISCOVERY OF WITNESS BENEFITS. A communication between a prosecutor, peace officer, corrections officer, or any other person known to the prosecutor and a witness for the prosecution in a criminal case or a representative of the witness regarding benefits or detriments that may be conferred on the witness as a result of the witness's participation or lack of participation in the case must be documented in writing and disclosed to the defense at least 30 days before the date the trial commences. SECTION 2. This Act takes effect September 1, 2005.
