A BILL TO BE ENTITLED

AN ACT

relating to authority to annex a water or sewer district.                     
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 43, Local Government Code, Section 
43.071, is amended by adding a new Subsection (g), to read as 
follows:

Section 43.071(g):                                                     
	(g)  Annexation of area under this section is exempt from the 
provisions of this chapter that prohibit reduction of the 
extraterritorial jurisdiction of a municipality without the 
written consent of that municipality's governing body if:
	(1)  the area is less than 100 acres; and                               
	(2)  upon completion of the annexation, all of the water or 
sewer district will be within the boundaries of the annexing 
municipality.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
