A BILL TO BE ENTITLED
AN ACT
relating to the operation of a motorcycle on which a young person is
a passenger.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 545.416, Transportation Code, is amended
by adding Subsections (d) and (e) to read as follows:
(d) Except as provided by Subsection (e), the operator of a
motorcycle may not carry as a passenger a person who is younger than
15 years of age, and a person younger than 15 may not ride as a
passenger on a motorcycle being operated by another, unless the
person's feet rest firmly on passenger foot pegs that are attached
to the motorcycle.
(e) Subsection (d) does not apply to:
(1) a motorcycle that is being operated in a residence
district at a speed that is less than 20 miles per hour; or
(2) a passenger who is seated in a sidecar attached to
the motorcycle.
SECTION 2. This Act takes effect September 1, 2005.
