A BILL TO BE ENTITLED
AN ACT
relating to additional reporting requirements for political
contributions and expenditures in regard to certain constitutional
amendment elections.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 254, Election Code, is
amended by adding Section 254.044 to read as follows:
Sec. 254.044. ADDITIONAL REPORTING REQUIREMENTS FOR
CERTAIN CONSTITUTIONAL AMENDMENT ELECTIONS. (a) This section
applies only to reporting requirements for an election on a
proposed constitutional amendment authorizing the extension of the
state lottery to include video lottery games, at regulated
locations where wagering is already authorized by law, the net
revenue from which shall be used for property tax reduction, public
education, and children's health care.
(b) In addition to other reports required by this chapter, a
person required to file reports for an election covered by this
section shall file additional reports as described by this
subsection. During the period beginning the 30th day before
election day and continuing through the day before the first day of
the period for early voting by personal appearance for the
election, reports shall be filed twice a week. During the period
beginning the first day of the period for early voting by personal
appearance for the election and ending at 12 noon on the day before
election day, reports shall be filed every 24 hours.
(c) In addition to other required contents of reports
prescribed by this chapter, each report required for an election
covered by this section must include:
(1) the full name, residence or business street
address, and principal occupation of each individual from whom
political contributions are accepted during the reporting period;
and
(2) if the person from whom political contributions
are accepted during the reporting period is an entity, the full
name, residence or business street address, and principal
occupation of each individual from whom political contributions are
accepted by the contributing entity during the reporting period.
(d) The commission shall adopt rules necessary to implement
this section. The rules must include provisions to ensure that the
identity of individual contributors to entities is fully disclosed
and apparent.
SECTION 2. Section 254.044, Election Code, as added by this
Act, is repealed effective January 16, 2007.
SECTION 3. This Act takes effect immediately if it receives
a vote of two–thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
