A BILL TO BE ENTITLED
AN ACT
relating to requirements imposed under the vehicle fleet management
plan.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 2171.101(b), Government Code, is amended
to read as follows:
(b) The office shall:
(1) develop automated information retrieval systems to
implement the reporting system;
(2) require monthly reports submitted by a state
agency under Subsection (a) to be submitted not earlier than the
45th day or later than the 60th day after the end of the month
covered by the report; and
(3) [(2)] maintain a complete inventory of agency
vehicles by class of vehicle.
SECTION 2. Subchapter C, Chapter 2171, Government Code, is
amended by adding Section 2171.105 to read as follows:
Sec. 2171.105. PROVISIONS APPLICABLE TO INSTITUTIONS OF
HIGHER EDUCATION. (a) An institution of higher education is not
subject to the minimum use criteria provided by the management plan
adopted under Section 2171.104.
(b) The management plan applies only to vehicles that are
purchased by an institution of higher education with appropriated
funds.
(c) The fleet manager appointed by the head of an
institution of higher education may request, and the office of
vehicle fleet management may grant, a waiver from the limit on the
number of vehicles subject to the plan that the institution may own.
(d) In this section, "institution of higher education" has
the meaning assigned by Section 61.003, Education Code.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
