A BILL TO BE ENTITLED

AN ACT

relating to enabling the use of biofuels (ethanol and biodiesel) in 
Texas.  
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 382, Health and Safety 
Code, Section 382.0171 is amended to read as follows:
	Section 382.0171.  ALTERNATIVE FUELS AND SELECT-USE 
TECHNOLOGIES.  (a)  In adopting rules, the commission shall 
encourage and may allow the use of natural gas and other alternative 
fuels, as well as select-use technologies, that will reduce 
emissions.  Diesel fuel, otherwise compliant with state rules and 
standards for diesel fuels, when blended with biofuels in 
proportions of less than 20% of biofuels, shall be considered to 
remain compliant with these rules and standards.
	SECTION 2.  This Act takes effect July 1, 2005.
