A BILL TO BE ENTITLED
AN ACT
relating to enabling the use of fuel ethanol and biodiesel in Texas.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 382, Health and Safety
Code, Section 382.0171 is amended to read as follows:
Sec. 382.0171. ALTERNATIVE FUELS AND SELECT-USE TECHNOLOGIES.
(a) In adopting rules, the commission shall encourage and may allow
the use of natural gas and other alternative fuels, as well as
select-use technologies, that will reduce emissions. Diesel fuel,
otherwise compliant with state rules and standards for diesel
fuels, when blended with fuel ethanol or biodiesel in proportions
of less than 20% of fuel ethanol or biodiesel, shall be considered
to remain compliant with these rules and standards.
SECTION 2. This Act takes effect July 1, 2005.
