A BILL TO BE ENTITLED
AN ACT
relating to authorizing a general-purpose political committee to
conduct a raffle to raise money for political purposes.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The heading to Chapter 2002, Occupations Code,
is amended to read as follows:
CHAPTER 2002. CHARITABLE AND POLITICAL RAFFLES
SECTION 2. Section 2002.001, Occupations Code, is amended
to read as follows:
Sec. 2002.001. SHORT TITLE. This chapter may be cited as
the Charitable and Political Raffle Enabling Act.
SECTION 3. Section 2002.002, Occupations Code, is amended
by amending Subdivision (2) and adding Subdivision (7) to read as
follows:
(2) "Qualified organization" means a qualified
religious society, qualified volunteer fire department, qualified
volunteer emergency medical service, [or] qualified nonprofit
organization, or authorized political committee.
(7) "Authorized political committee" means a
general-purpose committee as defined by Section 251.001, Election
Code.
SECTION 4. Section 2002.052, Occupations Code, is amended
by adding Subsection (g) to read as follows:
(g) Subsections (b) and (c) do not apply to a raffle
conducted by an authorized political committee.
SECTION 5. Section 2002.053, Occupations Code, is amended
to read as follows:
Sec. 2002.053. USE OF RAFFLE PROCEEDS. (a) All proceeds
from the sale of tickets for a raffle conducted by a qualified
organization other than an authorized political committee must be
spent for the charitable purposes of the organization.
(b) All proceeds from the sale of tickets for a raffle
conducted by an authorized political committee must be spent for
the purposes for which the committee is authorized by law to spend
political contributions received by the committee.
SECTION 6. Section 2002.054, Occupations Code, is amended
by adding Subsection (d) to read as follows:
(d) This section does not apply to a raffle conducted by an
authorized political committee.
SECTION 7. Section 2004.056, Occupations Code, is amended
by adding Subsection (e) to read as follows:
(e) Subsection (d) does not apply to a raffle conducted by
an authorized political committee.
SECTION 8. This Act takes effect on the date the
constitutional amendment proposed by the 79th Legislature, Regular
Session, 2005, authorizing political action committees to conduct
raffles to raise money for political purposes becomes effective.
If that constitutional amendment is not approved by the voters,
this Act has no effect.
