A BILL TO BE ENTITLED
AN ACT
relating to the inclusion of certain public school accountability information in a student's grade report card and on a school district's Internet website. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 39, Education Code, is amended by adding Subchapter J to read as follows:
SUBCHAPTER J. NOTICE OF PERFORMANCE
Sec. 39.251. NOTICE IN STUDENT GRADE REPORT. The first written notice of a student's performance that a school district gives during a school year as required by Section 28.022(a)(2) must include the following information: (1) the most recent performance rating of the campus at which the student is enrolled, as determined under Section 39.072; and (2) a definition and explanation of each performance rating described by Section 39.072(a). Sec. 39.252. NOTICE ON DISTRICT WEBSITE. Not later than the 10th day after the first day of instruction of each school year, a school district that maintains an Internet website shall make the following information available to the public on the website: (1) the information contained in the most recent campus report card for each campus in the district, as determined under Section 39.052; (2) the information contained in the most recent performance report for the district, as determined under Section 39.053; (3) the most recent performance rating of the district, as determined under Section 39.072; and (4) a definition and explanation of each performance rating described by Section 39.072(a). SECTION 2. This Act applies beginning with the 2005-2006 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
