A BILL TO BE ENTITLED
AN ACT
relating to continuing education requirements for renewal of a
structural pest control business license.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter G, Chapter 1951, Occupations Code, is
amended by adding Section 1951.3075 to read as follows:
Sec. 1951.3075. CONTINUING EDUCATION. (a) The board by
rule shall establish a continuing education requirement as a
condition for renewal of a structural pest control business license
under this chapter by a license holder who holds only a structural
pest control business license. At a minimum, the board shall
require that the business license holder complete at least four
hours of instruction annually in relevant areas of state law. The
board shall approve one or more courses that meet these minimum
requirements.
(b) The board shall adopt fees necessary to recover the
board's costs in implementing this section.
(c) The continuing education requirements adopted under
this section do not apply to a business license holder that operates
solely as a wood treater that treats wood on property owned by the
business license holder.
SECTION 2. The Texas Structural Pest Control Board shall
adopt rules and fees required under Section 1951.3075, Occupations
Code, as added by this Act, not later than January 1, 2006.
SECTION 3. This Act takes effect September 1, 2005.
