A BILL TO BE ENTITLED
AN ACT
relating to establishing internet sales of lottery tickets.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter F, Chapter 466, Government Code, is
amended by adding a new section to read as follows:
Sec. 466.257. Sale of Ticket Through Internet Computer
Terminal.
(a) The commission may sell a ticket by use of computer
terminals, through the internet, or by means of other electronic
devices that technology may permit.
(b) The commission shall adopt rules establishing a method
by which the commission shall sell a ticket by use of computer
terminals, through the internet, or by means of other electronic
devices that technology may permit.
(c) The commission shall create a practical method or system
by which an individual eligible to purchase a ticket may purchase a
ticket by use of a private or public computer terminal or other
electronic means through use of a debit account or by means of an
account established with the commission or by some other system
that provides for a practical means for the individual to purchase a
ticket by use of computer terminals, through the internet, or by
means of other electronic devices that technology may permit.
SECTION 2. TRANSITION. No later than January 1, 2006, the
commission shall create a method or system by which an individual
eligible to purchase a ticket may purchase a ticket as provided by
the Act and the commission shall adopt the rules as required under
this Act.
SECTION 3. EFFECTIVE DATE. This Act takes effect
immediately if it receives a vote of two-thirds of all the members
elected to each house, as provided by Section 39, Article III, Texas
Constitution. If this Act does not receive the vote necessary for
immediate effect, this Act takes effect September 1, 2005.
