A BILL TO BE ENTITLED
AN ACT
relating to limitations on the expansion of extraterritorial
jurisdiction of certain municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 42.022(b), Local Government Code, is
amended to read as follows:
(b) The extraterritorial jurisdiction of a municipality may
expand beyond the distance limitations imposed by Section 42.021 to
include an area contiguous to the otherwise existing
extraterritorial jurisdiction of the municipality if the owners of
the area request the expansion. A municipality with fewer than
5,000 inhabitants may not expand its extraterritorial jurisdiction
under this subsection beyond the extent of the extraterritorial
jurisdiction of a municipality with 5,000 to 24,999 inhabitants in
Section 42.021.
SECTION 2. The change in law made by this Act applies only
to an expansion of extraterritorial jurisdiction for which the
request in expansion required by Section 42.022(b), Local
Government Code, is provided to the municipality on or after the
effective date of this Act. An expansion for which the request is
provided before that date is governed by the law in effect at the
time the request is provided, and the former law is continued in
effect for that purpose.
SECTION 3. This Act takes effect September 1, 2005.
