A BILL TO BE ENTITLED
AN ACT
relating to the registration of certain trailers and semitrailers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 502, Transportation Code,
is amended by adding Section 502.189 to read as follows:
Sec. 502.189. CERTIFICATION PREREQUISITE FOR CERTAIN
TRAILER AND SEMITRAILER REGISTRATION. (a) In addition to the
requirements of Section 502.151, an applicant for registration of a
trailer or semitrailer that has a gross vehicle weight of 4,000
pounds or less must submit to the county assessor-collector a
certificate of authenticity issued by the Department of Public
Safety under this section.
(b) The Department of Public Safety shall issue a
certificate of authenticity to an owner of a trailer or semitrailer
who demonstrates that the trailer or semitrailer is as described in
the application for registration and weighs the amount stated in
the affidavit required by Section 502.151(c).
(c) The department and the Department of Public Safety shall
adopt rules and forms to implement and enforce this section.
SECTION 2. (a) Section 502.189, Transportation Code, as
added by this Act, applies only to an application for registration
of a trailer or semitrailer filed on or after January 1, 2006.
(b) The Texas Department of Transportation and the
Department of Public Safety shall adopt rules and forms as required
by Section 502.189, Transportation Code, as added by this Act, not
later than December 1, 2005.
SECTION 3. This Act takes effect September 1, 2005.
