A BILL TO BE ENTITLED
AN ACT
relating to the authority of certain political subdivisions to 
develop a parks and recreation system under the law governing 
sports and community venue projects.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter A, Chapter 334, Local Government 
Code, is amended by adding Section 334.008 to read as follows:
	Sec. 334.008.  PARKS AND RECREATION SYSTEM AS VENUE PROJECT: 
CERTAIN COUNTIES.  (a)  A county that has a population of less than 
2,000 and that contains no incorporated territory of a municipality 
may provide for the planning, acquisition, establishment, 
development, construction, or renovation of a county parks and 
recreation system as a venue project under this chapter.
	(b)  The venue project authorized by Subsection (a) 
includes:         
		(1)  improvements or additions to the county parks and 
recreation system; and
		(2)  an area or facility that is part of the county 
parks and recreation system.
	(c)  To the extent that a provision of this chapter, 
including Sections 334.024(f), 334.1015, and 334.2515, applies to a 
venue project that is a municipal parks and recreation system or 
facility, those provisions apply to a venue project authorized by 
this section, and references to a municipality are considered 
references to a county.
	(d)  A county that authorizes a venue project described by 
this section maintains the authority granted under this section 
even if at a later time a part of the county becomes incorporated in 
a municipality.
	SECTION 2.  Subchapter C, Chapter 334, Local Government 
Code, is amended by adding Section 334.045 to read as follows:
	Sec. 334.045.  SALE OR LEASE OF PUBLIC SQUARE OR MUNICIPAL 
PARK.  Section 253.001(b) does not apply to the sale or lease of a 
public square or municipal park for the acquisition, establishment, 
development, construction, or renovation of an approved venue 
project.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
