A BILL TO BE ENTITLED

AN ACT

relating to the collection of street lighting service fees by a 
county or by certain public or private entities contracting with a 
county.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 286.002, Transportation Code, is amended 
by adding Subsection (e) and (f) to read as follows:
	(e)  A public agency or a county may:  (1) offer street 
lighting service to persons in its territory;
		(2)  contract with a public or private entity to 
provide the street lighting service.
		(3)  require the use of the service by those persons;                  
		(4)  charge fees for the service; and                                  
		(5)  establish the service as a utility separate from 
other utilities in its territory;
	(f)  A fee for a service provided under this section may be 
collected by:
		(1)  the county;                                                       
		(2)  a private or public entity that contracts with the 
county to provide the service; or
		(3)  another private or public entity that contracts 
with the county to collect the fees.

SECTION 2.  This Act takes effect September 1, 2005.
