A BILL TO BE ENTITLED

AN ACT

relating to the liability of certain operators that contract with a 
metropolitan rapid transit authority.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 451.056, Transportation Code, is amended 
by adding Subsection (e) to read as follows:
	(e)  A private operator that contracts with an authority 
under Subsection (a)(3) to perform a function of the authority is 
liable for damages arising in connection with performance of that 
function only to the extent that the authority would be liable if 
the authority were performing the function.
	SECTION 2.  Section 451.069, Transportation Code, is 
repealed.               
	SECTION 3.  This Act takes effect September 1, 2005.
