A BILL TO BE ENTITLED

AN ACT

relating to the amount of export fees the Middle Pecos Groundwater 
Conservation District may assess.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 4(e), Chapter 1299, Acts of the 77th 
Legislature, Regular Session, 2001, is amended to read as follows:
	(e)  In addition to other fees assessed by the district, the 
district may assess an additional fee on groundwater transferred 
out of the district in accordance with Section 36.122(e)(1) or (2), 
Water Code, except that the fee may not [to] exceed 10 percent of 
the amount of the fee assessed for the production of water for use 
within the district if a production fee is assessed.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
